Demonstrating erudition worthy of La Revue d'histoire littéraire de la France, the contributors propose new ideas and points of view. By the sheer abundance of technical terms, the articles would have astonished the avant-garde poets and artists in question, who were so very fond of entertainment. Background and objectives Conscientious refusal of abortion has been discussed widely by medical ethicists but little information on practitioners' opinions exists. The American College of Obstetricians and Gynecologists (ACOG) issued recommendations about conscientious refusal. We used a vignette experiment to examine obstetrician-gynecologists' (OB/GYN) support for the recommendations. Design A national survey of OB/GYN physicians contained a vignette experiment in which an OB/GYN doctor refused a requested elective abortion. The vignette varied two issues recently addressed by the ACOG ethics committee—whether the (...) doctor referred and whether the doctor disclosed their objection to the abortion. Participants and setting 1800 OB/GYN randomly selected physicians were asked to complete a mail survey containing the vignette. The response rate was 66% (n=1154) after excluding 40 ineligible cases. Measurement Physicians indicated their approval for the vignette doctor's decision. Main results Overall, 43% of OB/GYN physicians responded that the conscientious refusal exercised by the vignette physician was appropriate. 70% rated the vignette doctor as acting appropriately when a referral was made. This dropped to 51% when the doctor disclosed objections to the patient, and to 12% when the doctor disclosed objections and refused to make a referral. Consistent with previous research, males were more likely to support disclosure and refusal to refer. Highly religious physicians supported non-referral but not disclosure. Conclusion OB/GYN physicians are less likely to support conscientious refusal of abortion if physicians disclose their objections to patients. This is at odds with ACOG recommendations and with some models of the doctor–patient relationship. (shrink)

The European Clinical Trials Directive was issued in 2001 and aimed to simplify and harmonise the regulatory framework of clinical trials throughout Europe, thus stimulating European research. However, significant complexity and inconsistency remains due to disparate interpretation by EU member states. Critical care research has been particularly impacted due to variable and often restrictive consenting procedures for incapacitated subjects, with some countries requiring a court-appointed representative, while others recognise consent from family members and occasionally professional representatives. Furthermore, the absence of (...) a waiver of consent threatened to put an end to emergency research in Europe and was met with varied responses. Approval procedures by ethics committees are equally inconsistent, particularly those relating to provision of a single opinion for multi-centre trials. Although evidence is somewhat mixed, this complexity as well as a general increase in administrative and financial burden following the Directive has been shown to cause a reduction in clinical trial activity in Europe, particularly academic trials. We aim to clarify some of these inconsistent procedures, particularly those relating to informed consent of incapacitated subjects, as well as discussing some general weaknesses and possible improvements of the Directive ahead of its planned revision in 2011. Eighteenth-century England saw the rise of a "peculiarly English" art form—landscape gardening—and a corresponding change in attitudes toward the antural world. While the French, who lived under tyranny, had a tightly organized, restrictive gardens, the "free" English enjoyed gardens where they were at liberty to wander. John Dixon Hunt examines eighteenth-century letters, literary and critical works, biographies, paintings, prints, and drawings to trace the gradual movement from formal regularity toward a carefully calculated naturalness.

Endothelial cells, when cultured on gelled basement membrane matrix exert forces of tension through which they deform the matrix and at the same time they aggregate into clusters. The cells eventually form a network of cord-like structures connecting cell aggregates. In this network, almost all of the matrix has been pulled underneath the cell cords and cell clusters. This phenomenon has been proposed as a possible model for the growth and development of planar vascular systems in vitro. Our hypothesis is (...) that the matrix is reorganized and the cellular networks form as a result of traction forces exerted by the cells on the matrix and the latter's elasticity. We construct and analyze a mathematical model based on this hypothesis and examine conditions necessary for the formation of the pattern. We show cell migration is not necessary for pattern formation and that isotropic, strain-stimulated traction is sufficient to form the observed patterns. (shrink)

In an essay entitled ‘Cinna the Poet’ published in 1974, T. P. Wiseman forcefully countered the arguments of Monroe E. Deutsch and others against the identification of the ‘neoteric’ poet Cinna with the tribune Gaius Helvius Cinna, who after Caesar's funeral was torn to pieces by an enraged mob, mistaken by it for the praetor Lucius Cornelius Cinna, who had applauded Caesar's murder. The identification of the poet with the tribune is supported by Plutarch, Brutus 20.4, where the murdered tribune (...) is called a ποιητικ⋯ς ⋯ν⋯ρ. As Wiseman says, ‘there are six other ancient accounts of the murder, drawn from a source or sources unknown; five of them call the victim a tribune of the plebs, and none of them says he was a poet. Impressed by this, many scholars have thought that the victim was not in fact the poet Helvius Cinna, and M. E. Deutsch suggested in 1925 that either the phrase in the Brutus describing him as a poet is a gloss, or “the tribune also dabbled in verse but was not the famous poet”.’ Wiseman's refutation of the various arguments of Deutsch and his followers against the identity of the poet and the tribune seems to me quite cogent, but the debate shows no sign of having been brought to a close: G. V. Sumner concludes his review of Wiseman's essay with an argument that the tribune was probably somewhat younger than the poet, and the suggestion that the tribune may have been ‘the adoptive, and hence homonymous, son of the poet’. The paper addresses the question of whether authenticity is a conceptual possibility for Dasein given Heidegger’s insistence in Being and Time that Dasein is necessarily fallen into its mode of everydayness and that fallenness is necessarily inauthentic. By exploring the relationship between Dasein and existentials, I reveal a structure of possibility in allexistentials that provides the seeming paradox a resolution. I use the concept of “logical existentialism” to explore what Heidegger may have meant when he talks of existentials and I (...) look at some passages from The History of the Concept of Time to read propensity as the substance of falling. In the process, l address and discard the only two real attempts in the secondary literature to cope with the paradox: that of Hubert Dreyfus and Rudi Visker.L’article se penche sur la question de savoir si l’authenticité est une possibilité conceptuelle du Dasein, étant donnée I’insistance de Heidegger dans Être et Temps à I’effet que le Dasein est nécessairement déchu dans ses modes de quotidienneté, et que la déchéance est nécessairement inauthentique. À travers I’exploration de la relation entre le Dasein et les existantiaux, je révèle une structure de possibilité dans tous les existantiaux qui permet une résolution du paradoxe apparent. Philosophers agree that scientific explanations aim to produce understanding, and that good ones succeed in this aim. But few seriously consider what understanding is, or what the cues are when we have it. If it is a psychological state or process, describing its specific nature is the job of psychological theorizing. This article examines the role of understanding in scientific explanation. It warns that the seductive, phenomenological sense of understanding is often, but mistakenly, viewed as a cue of genuine understanding. (...) The confirmation of scientific hypotheses has a quantitative and qualitative aspect. No empirical hypothesis can be confirmed conclusively, so philosophers of science have used the theory of probability to elucidate the quantitative component, which determines a degree of confirmation ‐ that is, the extent to which the hypothesis is supported by the evidence (see probability and evidence and confirmation). By contrast, the qualitative feature of confirmation concerns the prior question of the nature of the relation between the hypothesis and the (...) evidence if the hypothesis is to be confirmed by its instances. If a hypothesis is to be supported by a body of evidence, it must be related to the evidence in an appropriate way. The paradoxes of confirmation arise in the attempt to characterize in first‐order logic the qualitative relation between hypothesis and evidence. (shrink)

There is now a considerable literature on Michel Foucault but this is the first monograph which explicitly addresses his influence and impact upon education. Personal autonomy has been seen as a major aim, if not the aim of liberal education. But if Foucault is correct that personal autonomy and the notion of the autonomous person are myths, then the pursuit of such an aim by educationalists is misguided. The author develops this critique of personal autonomy and liberal education from the (...) writings of Foucault, and also considers Foucault's own educational practices. The author, James Marshall, who lives in New Zealand, has already written several articles for academic journals on Foucault. (shrink)
